Terms of Service

These Terms of Service (“Terms”) govern your access to and use oftokemon.si (the “Site”), our marketing API, waitlist, wallet sign-in, Genesis Points program, referrals, social tasks, and related pre-launch services (collectively, the “Services”). By using the Services, you agree to these Terms and ourPrivacy Policy and Disclaimer. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may not use the Services if you are barred under applicable sanctions, export-control, or anti-money-laundering laws, or if we have suspended or terminated your access. You represent that information you provide (including email and wallet address) is accurate and that you control the wallet you connect.

2. Pre-launch scope; no mainnet product yet

The Services are for marketing, waitlist registration, and pre-launch engagement. NFT minting, gameplay, PVP, tactics, agent wallets, and other product features described on the Site may not be available yet. We may change, delay, or cancel features without liability. Separate terms may apply when you mint or use on-chain products at launch.

3. Accounts, wallet, and email

• One account per person: We aim to bind one email and one primary wallet per waitlist account. Creating duplicate accounts, sharing accounts to farm points, or using bots is prohibited.
• SIWE sessions: Wallet login uses Sign-In with Ethereum. You are responsible for securing your wallet, device, and email. We are not liable for unauthorized access caused by lost keys, phishing, or malware.
• Email: You agree to receive operational messages about the waitlist and program. Marketing email will follow applicable consent rules; you may opt out where offered.

4. Genesis Points and referrals

Genesis Points are non-transferable promotional units tracked in our database. They have no cash value on the Site and are not redeemable for money. Point amounts, task rules, referral percentages (including two-tier referral credits), daily check-in caps, and campaign tasks may change at any time. We may correct errors, claw back points obtained through abuse, and disqualify users who violate these Terms or program rules documented on the Site or in official announcements.

Any future conversion of Genesis Points into in-game benefits, allowances, or other rewards—if offered—will be at our sole discretion and subject to additional rules, eligibility, and geographic restrictions.

5. Social and campaign tasks

Tasks that reference X (Twitter) or other platforms are voluntary. Unless we explicitly implement automated verification, completion may be honor-based. You must comply with third-party platform terms. Impersonation, spam, paid engagement rings, or misleading promotion of Tokemon is prohibited.

6. Acceptable use

You agree not to:

• Violate law or infringe others’ rights.
• Attack, scrape, or overload the Services; bypass rate limits or security controls.
• Reverse engineer the Services except where law permits.
• Misrepresent Genesis Points or Tokemon as an investment, security, or income scheme.
• Use the Services from prohibited jurisdictions if we restrict access.

7. Intellectual property

The Site, branding, artwork, species designs, and content are owned by Tokemon or licensors. We grant you a limited, revocable license to access the Site for personal, non-commercial use. NFT licenses for digital collectibles, if any, will be specified at mint or in separate license terms.

8. Third-party links and wallets

The Site integrates third-party wallet software, RPC providers, and social platforms. Your use of those tools is governed by their terms. We do not custody your assets. On-chain transactions you initiate are your responsibility.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. SEE OUR DISCLAIMER FOR NFT, CRYPTO, AND INVESTMENT-RELATED RISKS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOKEMON AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR THE FREE WAITLIST). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

11. Indemnity

You will defend and indemnify Tokemon against claims arising from your misuse of the Services, violation of these Terms, or violation of third-party rights, including misleading promotion of Genesis Points or NFTs.

12. Suspension and termination

We may suspend or terminate access at any time for any reason, including suspected fraud. Provisions that by nature should survive (disclaimers, liability limits, indemnity, dispute resolution) survive termination.

13. Changes to Terms

We may modify these Terms by posting an updated version on the Site. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires a different forum. You waive any right to participate in a class action to the extent permitted by law.
